Terms of Service

1. Acceptance of Terms

By accessing or using Our Channel ("the Service"), operated by Our Channel, Inc. ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old to create an account. By creating an account, you represent and warrant that you are 18 years of age or older. If you create a child profile on the Service, you represent and warrant that you are the parent or legal guardian of that child.

3. Account Registration

You must provide accurate and complete information when creating your account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.

4. Child Profiles and Parental Consent

Our Channel allows parents and legal guardians to create profiles for their children. By creating a child profile, you confirm that:

• You are the parent or legal guardian of the child, or have obtained verifiable consent from the child's parent or legal guardian.
• You consent to the collection and use of your child's personal information as described in our Privacy Policy.
• You understand that videos uploaded to the platform may include recordings of your child (e.g., reaction videos).

You may review, modify, or request deletion of your child's data at any time through your account settings or by contacting us.

5. Content and Intellectual Property

You retain ownership of all content you upload to the Service. By uploading content, you grant us a limited, non-exclusive, royalty-free license to store, process, transcode, and display your content solely for the purpose of operating the Service.

You agree not to upload content that:

• Is illegal, harmful, threatening, abusive, or otherwise objectionable.
• Infringes on the intellectual property rights of any third party.
• Contains children who are not your own or for whom you do not have parental/guardian consent to feature.

We reserve the right to remove any content that violates these Terms.

6. Acceptable Use

The Service is designed for private family use. You agree to use the Service only for its intended purpose and not for any commercial purpose. You may not share content from the platform outside of the Service without the consent of all parties depicted.

7. Invitations and Contributors

You may invite other adults to contribute content to your child's channel. Invited contributors are bound by these same Terms. As an admin, you are responsible for managing contributors and the content shared on your child's channel. Content contributed by a removed contributor may be retained on the platform at the admin's discretion.

8. Privacy and Data Handling

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information, including children's personal information in compliance with the Children's Online Privacy Protection Act (COPPA).

We use third-party service providers to operate the platform, including for video processing, authentication, database management, and email delivery. These providers process data solely on our behalf and are contractually obligated to protect your data.

9. Service Availability

We strive to keep the Service available at all times but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

10. Termination

You may delete your account at any time. Upon account deletion, we will delete your personal information and your children's personal information in accordance with our data retention policy. We may also terminate or suspend your account if you violate these Terms.

11. Limitation of Liability

To the maximum extent permitted by law, Our Channel shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you have paid us in the 12 months preceding the claim.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via the email associated with your account. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
